Our mission is to provide reliable, top-of-the-line equipment and unmatched customer service, helping our clients complete their projects efficiently and safely. These Terms and Conditions outline the expectations and obligations for both GBPH and our customers to ensure a seamless and professional hire experience.
1. Definitions
- “Company” refers to George Burns Hire (GBPH).
- “Customer” refers to any individual, company, or organisation hiring services or equipment from the Company.
- “Equipment” refers to any machinery, tools, or items hired out by the Company.
- “Agreement” refers to these Terms and Conditions and any related documentation, including quotes or invoices.
2. Service Commitment
- GBPH specialises in plant hire services tailored to meet the unique needs of each Customer, whether for large-scale infrastructure projects or smaller independent jobs.
- We offer flexible hire periods, with options for operated or self-drive equipment.
- Expert advice is available to help you select the right machinery for your project.
3. Hire Period
- The hire period begins on the date specified in the hire agreement and ends when the equipment is returned to the Company or collected by us.
- Extensions to the hire period must be arranged in advance and may incur additional charges.
4. Equipment Quality and Usage
- All equipment is provided in good working condition and is maintained to industry standards.
- The Customer must inspect the equipment upon delivery and notify the Company immediately of any defects or issues.
- The Customer is responsible for using the equipment safely, adhering to applicable health and safety regulations, and ensuring proper care and maintenance during the hire period.
5. Delivery and Collection
- GBPH offers delivery and collection services across the Central Belt, Highlands, and Borders.
- The Customer is responsible for ensuring access to the delivery or collection site at the agreed times.
- Any delays or failed deliveries caused by the Customer may result in additional charges.
6. Customer Responsibilities
- The Customer assumes full responsibility for the equipment during the hire period, including ensuring proper operation, storage, and protection from damage or theft.
- Equipment must not be modified, sublet, or transferred without prior written consent from the Company.
- The Customer is liable for any damage, loss, or excessive wear to the equipment beyond normal use.
7. Operated and Self-Drive Options
- For operated hire, the Customer agrees that all operations are performed by GBPH personnel to the highest safety and industry standards.
- For self-drive hire, the Customer must ensure that operators are suitably trained, qualified, and competent to use the equipment.
8. Payment Terms
- Payment terms will be outlined in the invoice or quotation and must be adhered to.
- Late payments may result in additional charges or suspension of services.
- Any costs associated with repairs, cleaning, or loss of equipment will be charged to the Customer.
9. Cancellations and Refunds
- Cancellations must be made in writing at least [insert notice period, e.g., 48 hours] before the hire period begins.
- Late cancellations may incur a cancellation fee.
- Refunds are issued at the Company’s discretion and in line with applicable laws.
10. Liability and Insurance
- The Customer is responsible for ensuring adequate insurance cover for the equipment during the hire period.
- GBPH is not liable for indirect, consequential, or incidental damages arising from the use of the equipment.
- The Company’s total liability for any claim shall not exceed the total hire charges paid by the Customer.
11. Health and Safety
- The Customer agrees to operate all equipment in compliance with applicable health and safety regulations.
- GBPH provides guidance on equipment use upon request, but the Customer bears ultimate responsibility for its safe operation.
12. Termination of Agreement
- The Company reserves the right to terminate the hire agreement if the Customer breaches these Terms and Conditions or fails to make payments.
- Upon termination, the Customer must immediately return the equipment or arrange for its collection.
13. Governing Law
- These Terms and Conditions are governed by the laws of Scotland.
- Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
14. Amendments
- GBPH reserves the right to amend these Terms and Conditions at any time.
- Customers will be notified of any changes, and such changes will take effect immediately unless otherwise stated.
